[Speaker 1] if the patient has been advised surgery he takes DAMA, I have written that DAMA. but this surgery I have done one surgery and then the patient has taken discharge against medical advice and gone to some other hospital where he has been told that the first surgery was not done properly and because of this you will have to have a lot of inconvenience and you will have to do undergo multiple surgeries. In that situation if they put a case against me how much is my liability?
[Speaker 2] See this is very common. but again this is rightly said by you the moment you have taken a DAMA that means very clearly you have explained to the patient that these are the going to be the process procedure required of further treatment required. That was your medical advice. And you being a expert are definitely going to do that. now patient has not followed your advice and you have taken a signature on that. and you have discharged the patient against medical advice. then you are absolutely safe in that ground if patient went to some other doctor some other complication happens It is a duty of patient to prove in a court of law that whatever I have done as a first surgery is there is any negligence on that part or he need to prove that ki why he has taken a DAMA when doctor has advice for further treatment. So this is a very good piece of defenses.
