[Speaker 1] patient who requires a surgery is in a grey area where he may become all right without surgery, he may not become all right without surgery, whatever. Matlab he may become all right without both the things, the time period may be differ and everything. Shall we still what happens is what is my liability if I don't operate? Is there and patient has a long-term complication? Is there any liability of me that if I don't operate? If I have counseled that patient, I am deciding not to operate. My my medical advice is not to get operated. Some other doctor says no operation hona chahiye tha because it would have been better for the patient. Now in this case it is your clinical evaluation, your assessment is done on the basis of all X-ray other thing with your experience and knowledge. So when you have taken a call for a particular thing and you have done and gone with that, even if complication happen you will be safeguarded. There's no question that you are going to be held liable. But again coming down to the same part of the consent where it is very categorically we have said that you alternative need to be explained to the patient. Now your first advice was very clear, which you have already taken a call and decided and with the possible complication, but alternatively, you have explained that yes, possibility of surgery is there but I am trying for conservative treatment because that is also one of the protocol of the treatment. And if at all he goes with alternative, well and good. If it goes with your advice, it is good. If it goes with alternative, naturally it is refusing your consent, you're refusing your advice that conservative treatment will be the best treatment.
