[Speaker 1] Patient is lying for three, four days and then develops bed sores. Okay, wounds. Because of that basically the treatment gets delayed, which is very unfortunate for anyone. I don't think it should happen with anyone. But what is the orthopedic surgeon's liability where the patient is not coming on the table because of fitness, because of blood, hemoglobin, low hemoglobin, whatever. At least some part of fitness should be there before we can operate. Maybe three, four days. And he's developed a bed sore. Now I cannot operate for four, five more days because the bed sore has to heal. So what is my liability of a bed sore? Is the surgeon responsible? [Speaker 2] The orthopedic is not liable but treatment need to be considered. And that is the reason what rightly said in every judgement and all that, you need to prepare a document and wherever whatever communicated with the patient must be documented in a proper way. In such a cases, if you have done your job that yes, it is going to take two, three days and if at all bed sore happened, you have mentioned that, you know, shown to the surgeon or whatever and treatment as antibiotic is continued. Naturally you being a one of the treating doctor, taking care of them and documenting everything and then it got delayed because of whatever the reason. If something goes wrong, you are not going to be liable because you have done every duty. Again, the same word comes, due care. Have you have done all possible care which required by the law or which required as per the qualification? If that is done, you are not going to held liable in such a scenario situation also. But yes, many of the time vicarious liability do come on a hospital that why proper care has not been, why bed sore has happened, why, you know, lots of questions do come where naturally we need to defend when our patient has not been put on a water bed or not been rotated when required and there could be some reason why patient has got bed sore. So that definitely is going to be the part and parcel with the staff nurse and other things and their document is going to speak about that. So liability, they can make you orthopedic as a party but orthopedic surgeon has got a good defenses in that corner because they have not touched the patient, not seen the patient, continuously advised the thing and which wasn't followed by the staff nurses and staff appointed by the hospital. So you can be safeguarded. But yes, hospital also need to defend themselves with their documentation to prove that all possible care was given.
