[Speaker 1]: You can add this line in a consent paper that I am happy with the facilities of this hospital as the line. And or you can also write, especially in patients when we are operating that we don't have ICU and I am still happy with the facilities of hospital and I'm going ahead with the surgery. Can this line be added in the consent paper and will that be acceptable in saving me in case patient, because sometimes patient may still do the case when they have to be shifted to ICU, the cost increases, and there is some untoward complication, the patient eventually succumbs. These are all not in our control because no doctor would ever want their patient to die because then that is a failure of the treatment. So that how should we handle this situation? [Speaker 2]: See there is a question of unfair trade contract. Unfair trade contract where we take in writing the things which is against the law. Simple. [Speaker 1]: Right. [Speaker 2]: So if patient write that I am not going to file a case against you, I give a consent that in spite of everything I'm not going to go court of law. These are against the law. So such thing is not accepted. Even if at all patient has written and signature is not going to be safe, it is going to be termed unfair trade contract. Now here the question of ICU. When you are doing a conservative treatment for the patient, you know in IPD setup it can be done where procedure are already going to be there and you have explained the patient ki bhai ICU is not going to be needed and this hospital does not have a ICU and that consent if you have taken, well and good, can be safeguarding. But if at all you are going to do a procedure, you need to explain the patient, baba we don't have a backup facility at this hospital but we have got a neighbor hospital where ICU facility is there. If required, we can shift you there and we are taking consent for that. Then that consent is going to be safeguarding to you for any defense you are going to have in court of law for the purpose of liability.
