[Speaker 1] What about the liability of the RMO which I have appointed? And the other RMOs, other RMOs in another hospital, what is their liability for me? Matlab how am I liable for them? [Speaker 2] No, for them you are not liable if at all this scenario situation is there. But now these RMOs are working with you and you have already treated a patient and treatment has been continued and RMO has failed in doing their duty. Instruction not been properly followed or something goes wrong in absence of yours but it is your patient, then a vicarious liability will just definitely going to be on you. I'll give a very beautiful example. It was a case of Rajiv Gandhi hospital where this patient was referred to this orthopedic department being a government hospital and the houseman has given an injection which leaded to septicemia. Patient got admitted to tertiary care center and died. The backache pain. Now here, I argued for the referring doctor, I got a relief but patient has filed 28 crore compensation case which is pending in court of law. [Speaker 1] 28 crore. [Speaker 2] 28 crores. In that case. And the HOD was made liable, surprisingly, because unit head name is there on a form in a government hospital. And he never seen the patient. But court has said to keep cleanliness of the department, sterility of department or disinfectant of department is your duty because it comes under you. So vicarious liability cannot be resolved. So any mistake done by your staff, RMO or otherwise, if you are a treating doctor or a hospital owner, vicarious liability definitely going to come on you.
